Constitution as Contracts, Constitution as Charters

A recent line of work has called into question social contract theories of constitutions on both normative and positive grounds.

Professor Ginsburg argues that modern developments in contract theory provide numerous useful ideas that help us to understand the social and political foundations of constitutions as a positive matter. While contract theory may not explain all aspects of constitutions, it does a better job than the competing theories that have been offered to date by the critics.
